A former Cape Cod man who continued to collect his mother's government pension checks after she died has been sentenced to five months in prison.

John O'Donnell Jr. formerly of Harwich, was also sentenced in federal court on Tuesday to five months of home confinement, two years of probation, and ordered to pay nearly $140,000 in restitution to the government.

Prosecutors said O'Donnell, 61, collected pension checks from 1997 to 2005 after the death of his mother in April 1997. 

His mother was entitled to the checks as the surviving spouse of former Harwich Port postmaster John O'Donnell Sr., who died in 1980, but prosecutors said her son was not entitled to the money.
