Do You Roll Over When Stung By Defective Products?

It is said that you get what you pay for. So don't be surprised if you buy a hammer in a dollar store for a buck, and a couple of days later it comes apart in your hands. But here's the frustrating thing—all too often you buy a reputable brand only to find out the product was manufactured offshore with dubious quality. Little wonder defective products lawyers are in demand.

Lest you think you're the only one having such a problem, with more manufacturing moving away from the American union label, build quality in everything from tires to the pills you pop, suffers. And when a host of people suffer in similar fashion, that's when a class action suit comes along—such as the one from 2007 when a class action lawsuit was filed against LG Electronics USA on behalf of consumers who purchased LG front-loading washers plagued with mold and mildew under normal use.

Lawsuit settlements have been substantial, especially when a safety issue is involved. And the advantage of a defective product class action is that you don't bear the burden of a lawsuit alone. With class action, a primary individual serves as the lead plaintiff. All you have to do is join in as a class participant. Then, when a settlement is reached, you get to share in the spoils.

But there is a caveat with a class action—and that's the number of participants there are in the class. $100 million dollars may seem like a huge award. However, if the class contains tens of thousands of people, the rewards aren't quite as evident once court costs and legal fees are deducted, with the remainder spread out across the thousands of participants.

If you have been stung from a defective product—from a car accident caused by a defective tire made in China, a defective appliance that caused a fire in your home, or some defective toy that may have put one of your kids in harm's way, it would be prudent to contact a defective products lawyer in order to explore the most appropriate option for you.

It may well be, in your situation, that participation in a class action lawsuit might be the way to go. But not always. Sometimes it's more appropriate to go it alone. Lawsuit settlements can be, in some cases, higher for the individual litigant. One thing's for sure, however, regardless of which option you choose: manufacturers should never be let off the hook for taking your heard-earned money and giving you something defective in return, just because they want to appease their shareholders. That's not fair to you.
