Overview of Personal Injury Law

By definition, a personal injury is one that affects an individual in a bodily, emotional, or mental manner, and this is the area of damages that are dealt with by personal injury law. Property damages may be included within civil court lawsuits that attempt to collect compensation for damages to the person and their property through an accident or deliberate attack. Each state and every country will have varying laws and court customs, so it is good to retain a local personal injury attorney if a lawsuit to recover monetary compensation for these types of damages is desired.

Claims frequently pursued under common lawsuits for personal injury damages include wage losses, medical expenses, rehabilitation expenses, pain and suffering, defamation, slip and fall injuries, product failure and disease damages. Accidents are the usual cause for personal injuries, but some are due to a deliberate attack by another human. Medical injuries include malpractice and medical negligence.

Some occupations, such as mining and factory work have resulted in fatal cancers that only are found decades after exposure. Mesothelioma, asbestosis and other life-threatening diseases take a long time to develop to a point where they can be diagnosed, but by that time is normally is a fatal condition. These diseases are directly related to exposure to toxic substances like asbestos on the job.

Most personal injury lawyers will offer a first consultation to clients at no charge, during which time it is decided whether the case is going to be accepted. This also gives the client an opportunity to determine if they are comfortable working with a particular personal injury attorney or law firm. Fees are normally only charged when a case is won or settlement is made. It is important to make claims immediately upon injury or wrongful death to meet any time limits that may be applicable to a case.

Some nominal ordinary charges are expected to be paid as they occur, such as some small office fees, but the majority of the legal fee is collected upon payment of an award or settlement. If the case is not won, the client is not billed for the legal fees. One reason for this is to allow the damaged party to pursue their rights of fair compensation without incurring financial hardship. Personal injury cases can take many months or years to be completed, and a delayed fee payment is beneficial to the client who otherwise may not be able to sue for their damages.

Another reason some personal injury cases are lengthy is that a lot of research, investigation and tracking may be necessary. Expert witness may be required, and in the case of product defects, time is required to trace back liability to the responsible party. Roughly 95% of personal injury lawsuits are settled and do not go forward into a courtroom/jury situation. It is advantageous to both parties to settle out of court, to cut costs and make payment more affordable. Many settlements are made in the form of a structured settlement over time rather than a lump sum.
