California Labor Laws Help Job Loss Victim Net $8.2 Million

Most of us don't give California labor laws a passing thought—until the day comes when you are wronged by an employer through no fault of your own. To that end, Maria Martinez must be very pleased that labor laws exist as they do, given that she was awarded more than $8 million dollars in a wrongful termination case.



Wrongful termination lawyers afford the skill and expertise necessary to take on what are sometimes large corporations attempting to put an employee through an unnecessary ringer.



In similar fashion, workers compensation lawyers provide valued counsel when worker's compensation benefits and rights are denied, or other issues relating to workers who are injured on the job.



In the California case, Martinez had worked for Rite Aid Corporation since she was 19 years of age, starting in 1993 as a pharmacy technician. She was fired from her job in July 2007 after more than 23 years with Rite Aid.



Her firing followed a disability medical leave. Upon her return to work, Martinez was allegedly taunted by fellow employees after her medical condition was somehow disclosed. Her work ethic was questioned and Martinez was 'written up' for what were described in a "Wrongful Termination Lawyer">Wrongful Termination lawsuit as manufactured issues.



The taunting involved such hurtful terms as "psycho" and "go see your psychotherapist."



The plaintiff testified at trial that in spite of retaining her capacity to perform all of her duties, she was transferred repeatedly by her employer. Rite Aid Corporation soon fabricated, it was alleged, a reason to fire her.



Losing a job of such long tenure, and most likely the only job Martinez had ever known in her adult life would have been, needless to say, a traumatic experience. To the plaintiff's credit, Martinez consulted legal counsel and decided to fight her dismissal, rather than simply accept the status quo and walk away a victim.



Martinez sued for wrongful termination, harassment and invasion of privacy in a lawsuit filed in Los Angeles Superior Court in November 2008.



This fall she was awarded $8.2 million by a jury. It is not known if the defendant will appeal.



California labor laws are there to protect workers like Maria Martinez from unfairness—and in this case wrongful termination lawyers came to her rescue and helped her achieve a just and appropriate compensation for her suffering. In much the same way, workers compensation lawyers will deliver the experience and expertise to defend clients with workers compensation claims. The bottom line remains—if you have been wronged, it pays to fight back.
