When is an Accident Not an Accident?

Let's face it. Accidents happen, despite your best intentions. However, when an accident occurs through no fault of your own due to the negligence of others, a personal injury lawsuit might be an option you consider.


You may think that contacting a personal injury attorney is an unnecessary response. 'I'm tough, I can take it, accidents happen, I couldn’t be bothered with the process.' The list goes on.


However, consider that your injury may come back to haunt you later, when advancing age accents and expands discomfort that may not have been an issue previously. A personal injury accident could affect your job, and therefore your livelihood. An injury could affect the way you relate to your family. And consider that personal injury settlements can reach into the millions of dollars.

Tawanda Howard, a woman who suffered from mental retardation and cerebral palsy prior to a 2008 collision while riding in a taxicab, was awarded $957,250 for her injuries. As a result of the taxi car accident,Tawanda suffered gastrointestinal injuries that required hospitalization for a month, and two surgeries. The woman has been in a wheelchair ever since.


A pretrial settlement was reached for $1 million less defense attorney's fees.


Then there was the case of a man already suffering from pre-existing depression and orthopedic disability when he was rear-ended by a truck while stopped in traffic. Even in light of the impact his pre-existing disability had on his case, the victim was nonetheless awarded $1.5 million for his pain, suffering and future care.


There can be all kinds of injuries. Being stopped in traffic, with your signal on, doing everything you are supposed to do, only to have someone adjusting their GPS or sneaking a peak at their text messages pile into the back of your car, or T-bone you at an intersection.


You could be walking along a restaurant floor and slip on the newly mopped ceramic tile after an employee neglected to put a cautionary sign in the area, alerting patron's to the hazard.


The bottom line is that you are not at fault. But you pay the price, in terms of pain, suffering and lost earnings. Personal injury settlements can go a long way in paying your medical bills, and supplementing your income, for an event that occurred through no fault of your own. A personal injury lawsuit is often the only response that will see justice served, through the services of a personal injury attorney.
